Orlando Motorcycle Accident Lawyer Who Understands Your Case

Three motorcycle riders were injured in an Orlando wreck in April. The accident occurred when an SUV changed into the right lane and veered into the path of one of the motorcyclists. The motorcyclist steered onto the shoulder of the road to avoid the SUV and then hit a construction trailer on the road shoulder. Two other motorcycle riders had to drop their motorcycles in order to avoid striking the first victim.

“Studies find that drivers who text generally take their eyes off the road for about 5 seconds. If you’re driving a car at 55 mph, you’re essentially driving the length of a football field blindfolded. Most drivers who spend any amount of time on the road might notice someone who is swerving from lane to lane. A decade ago you might have thought that the driver was drunk. Nowadays, it’s more likely that the person is distracted by a cellphone.”

Preventing Motorcycle Accidents

Planning for bad weather is a terrible way to try to bring down the rate of fatal motorcycle collisions. The National Highway Traffic Safety Administration (NHTSA) has provided some tips that can actually improve safety conditions. The tips were published in the start of May, because May is Motorcycle Safety Awareness Month. The NHTSA advises people to:

– Ensure a motorcycle rider has the full width of a lane at all times and not encroach on the rider’s space.
– Check mirrors and blind spots carefully because motorcycles are smaller and harder to see than cars are.
– Allow at least a three to four second following distance to avoid getting too close to a motorcyclist and potentially hitting him an emergency.
– Avoid distracted and impaired driving.
motorcyclists are advised to:
– Wear helmets that are compliant with minimum Department of Transportation specifications.
– Obey all traffic safety laws.
– Wear clothing that is brightly colored to increase the chance of a driver seeing you.
– Stay right in the middle of the lane where you are most visible.

If both motorcyclists and drivers take the NHTSA tips to heart and follow the advice, hopefully there will be fewer motorcycle fatalities in the future.

Atlanta Car Accident Attorneys and Distracted Driving

April is Distracted Driving Awareness Month, and as part of a collaborative effort, the Georgia Trial Lawyers Association, the Georgia Department of Highway Safety have teamed up to educate young drivers of the potential dangers.

Do I Need an Attorney – Distracted Driving

Distracted driving car accident lawyers in Atlanta believe this is an excellent time of year to drive home the point, given that graduation and summer break are right around the corner. YouTube

Study finds 1 in every 4 accidents involves cell phone use

Distractions can also be blamed on approximately 450,000 injuries each year.

A recent report from the National Safety Council indicates that 1 of every 4 wrecks can be attributed to cell phone use. Interestingly, only a small portion of those are blamed on text messaging, though teens are more prone to texting than other drivers.

This kind of faulty thinking is perpetuated by the fact that while all states have some form of text messaging ban, none ban talking on a phone for all drivers. What’s more, none forbid hands-free cell phone devices, despite the fact that research has proven they are equally as dangerous as handheld devices.

Measuring the Scale of Loss

The $871 billion in losses that the NHTSA calculated included $277 billion in actual economic expenditures like medical treatment. These costs average out to around $900 per U.S. citizen. The total also included $594 billion in harm resulting from the loss of life, the decreased quality of life from those seriously injured, and the pain that the injured endure.

There are three specific types of collisions that are responsible for the majority of these costs and losses: drunk driving accidents, speeding accidents and collisions caused by distracted drivers.

Crashes caused by drunk drivers accounted for a total of 18 percent of all of the economic losses and 23 percent of the overall societal harm that resulted from motor vehicle collisions in 2010. In total, there were $49 billion in economic losses and another $199 billion in losses to society that occurred because of drivers who were impaired by alcohol. The economic losses alone averaged out to $158 for every single person in the country.

Crashes caused by speeding drivers accounted for 21 percent of all of the economic losses and 24 percent of the overall societal harm that occurred due to motor vehicle accidents in 2010. In total, the economic losses from speeding drivers equaled $59 billion or an average of $191 per person in the United States.

Finally, crashes caused by distracted drivers accounted for 17 percent of total economic loss and 15 percent of overall societal harm. The economic losses totaled $46 billion and the societal losses totaled $129 billion.

“Gary – I’d love to have your advice on this. It was a great day for me to be riding my Harley. And then it happened. This elderly woman pulls out of a fast food restaurant’s parking lot. She was trying to turn left and pulled out in front of me. I broke my right ankle and actually had to have surgery on it because it was really messed up.
Do I need a lawyer? And can you help me???” -Glenn in Norcross.

You need a lawyer and I would be happy to help you.

But let me give our viewers some alarming statistics from government studies about motorcycle accidents:

* In 2011 in Georgia, there were 149 motorcycle accident fatalities.

* Motorcyclists are 35 times more likely to experience a deadly accident on the road than those in passenger cars.

And Glenn – that is what you said happened in your wreck. The at fault driver was attempting to turn left out of the fast food restaurant driveway when she pulled out in front of you.
Now what is the main reason these motorcycle accidents happened?
The driver of the other vehicle did not see the motorcycle before the collision, or did not see the motorcycle until it was too late to avoid a collision.

First – from the perspective of the person riding the motorcycle.
Here are 5Tips I’d like to share:
(1) Perform a Bike Safety Check BEFORE you ride!
Start with the tires. Make sure they are property inflated by using a good tire pressure gauge.

Check your lights, turn signals and brakes. Please make sure they are in working order.

And this really does apply to all of us, not just to motorcycle riders.
Speed kills.

(3) Wear a quality protective helmet.
Head injury is the #1 cause of deaths in motorcycle crashes.

In 2008 in Georgia, 97 motorcyclists lives were saved because they were wearing a proper helmet at the time of their crash.
Georgia requires all riders and passengers to wear a helmet.

Make it a habit to do this – even in daylight hours.

(5) Wear high visibility, protective clothing.
Colors that stand out – like yellow, orange, or bright red jackets will help you be seen by others.

Now here are a couple of helpful hints for all of us:

You should always double check to make sure the road is clear before you pull into a roadway from either a stop sign, a yield sign, or a driveway.

(2) Keep your eyes on the road!
Please put down that cell phone when you are behind the wheel.

Glenn: you were hurt in this wreck because the other driver pulled out in front of you.

However, just because she was cited for causing the wreck does not mean her insurance company is going to compensate you fairly for your injuries.

Insurance adjusters are trained to act like your long lost friend. They will tell you things like “You don’t need a lawyer. We are here to help you.”

You really have to ask yourself – Do you want to take on the insurance company and THEIR lawyers by yourself?

* Injured victims receive an average of 40% more money just by consulting a lawyer to learn their rights!
So just by talking with a lawyer the injured victim received 40% more money than when they tried to handle the claim on their own.

* Injured victims receive an average of 3 and ? times more money when they hire an attorney to defend their rights!

Let’s put that in real dollars.
Suppose an injured victim that DID NOT have an attorney settled their claim for only $3,000.00. If they had hired an attorney, they could have settled the case for $10,500.00.
If you have been hurt in a wreck and you don’t hire an attorney, you are letting the insurance company hang onto YOUR money. Plain and simple.

Hi Gary. I had a replacement hip surgery about 3 years ago. Immediately after the surgery everything seemed to be ok so I thought the results were fine.
It is about your health – first and foremost. Get to a doctor so they can treat you and get better.

The specific hips recalled were the DePuy ASR and some DePuy Pinnacle models.

(2) The other big hip recall involves the Stryker Corporation.

The Stryker Recall was made in June 2012.
Why were these hips recalled?
Because metal ions were shearing off of the cup in which the ceramic ball of the hip was placed, causing these tiny metal fragments to lodge in the surrounding tissue or to be released into the bloodstream.

. Pseudo tumors
. Heavy metal poisoning
. Revisionary surgery

. Kidney problems and possible renal failure
. Neurological issues

. Loss of vision or hearing

. Gastrointestinal disorders
There are 5 things you need to know when it comes to the Stryker recall:

(2) You may be entitled to compensation if you received one of these Stryker implants and you are experiencing pain, swelling and immobility
(3) You will need to know the name of the surgeon who performed your surgery

(5) Joining a class action law suit against Stryker may not get you the full compensation you deserve.

If you believe you have a hip implant that has been recalled, what should you do next?

(1) Document everything!

You may consider having a second opinion from a different surgeon about your pain.

Only a lawyer can get you the full compensation you deserve for your injuries. Just because you had one of these hip recalls does not mean Stryker will be reaching out to you and giving you money.
Also realize this: DO NOT DELAY IN PURSUING THESE CLAIMS.
