Currently under Austin city ordinance, you may not text while driving (I hope!) or use your smart phone to make dinner reservations, movies times, or check football scores while caught in Austin traffic, as these activities are both illegal and dangerous. But, how many of you will admit to talking on your cell phone while behind the wheel? Just a quick glance at the drivers around you on any road will confirm that most of us do it. Maybe it’s just a way to pass the time during a boring commute or you try to squeeze a few more minutes of work conversations before meeting the family at home for dinner. Federal law requires Truck drivers to keep a log of their hours.

And how long are truck driver’s required to keep their driver’s logs?
Federal regulations only require the truck driver’s to keep these logs for six months unless an attorney takes action to secure them.
So if we are hired, we immediately send the trucking company and their insurance company a letter telling them they can’t destroy the driver’s logs as this is important evidence for our client’s claim.
Now let me give you some other factors we investigate when taking on the trucking companies.
We look to see how well the tractor and the trailer are maintained.
Federal law requires these companies to keep their equipment in proper working order AND to keep records regarding this maintenance.

Keep in mind: in order to drive these big trucks, the drivers must have a commercial driver’s license.

(1) Drive with caution around trucks on the road.
Remember they cannot stop on a dime so don’t pull in front of one and assume they can safely stop in time.
(2) Stay visible to the truck driver.
If you can’t see the driver’s mirrors, chances are he can’t see you.

* According to the National Highway Traffic Safety Administration (NHTSA), in 2006, there were 6,964 people killed in crashes involving young drivers ages 16 – 20.
* In 2005, there were 3,374 drivers between the ages of 16-20 that were killed in car wrecks.

* 37 will be ticketed for speeding.

* 13 will be injured in automobile accidents.

And let me share with you a study on drivers’ education that was conducted by George Mason University in Virginia. This may give us a little clarity on why teenagers may be more likely to be involved in accidents when they get behind the wheel.

We, as parents, can’t rely on the traditional driver’s education programs at school to adequately prepare our teens to get behind the wheel.

* gradually release them to drive further distances and in more congested traffic as they demonstrate their ability to handle it.
* the more maturity and skill they demonstrate, the more the “leash” is released.
* But parents need to simultaneously train and monitor the teen drivers as they learn.

Now let’s address the “Do’s and Don’ts if you are ever involved in a car wreck:
DO’s
* If someone is injured, call 911 immediately!
* ALWAYS call the police to come to the scene to complete an incident report. The investigating officer will help document the scene of the wreck, gather the facts, interview witnesses, and prepare a report. If you don’t do this, it could be your word against the other driver.

-Name

-Phone numbers
-Make, model, color and year of the vehicle

-Insurance information
* Also get the same identifying information for any witnesses.

Include property damage to all cars, and any debris in the road at the scene.
* Report the wreck to your insurance company – even if you were not at fault. This is especially important if it appears the other driver did not have insurance.

* NEVER leave the scene of the wreck.

* Don’t talk with the insurance company – or sign any papers with the insurance company – until you have a chance to discuss it with your lawyer.
* DO NOT – DO NOT – accept any quick settlement offer from any insurance company.

Insurance companies are out there with these fast response vehicles.
